All bookings made through www.roomsdirect.co.nz (the “Website”) are subject to the following terms and conditions (the “Terms and Conditions”). By booking any accommodation through the Website, you agree to be bound by these Terms and Conditions. If you do not agree to be bound to these Terms and Conditions, you should not make any bookings through the Website.
1. Booking arrangements
1.1 You must be at least 18 years of age to make a booking through the Website.
1.2 All bookings made by you through the Website are made directly with the relevant accommodation provider (the “Provider”).
1.3 Any booking is a contract between you and the relevant Provider and is subject to those Provider’s terms and conditions (which will be advised to you at the time of booking).
1.4 Before confirming the booking, you should carefully read all terms and conditions specific to the accommodation you intend to book, particularly the terms and conditions relating to changes and cancellation of bookings.
1.5 You are solely responsible for checking that all details of your booking are correct.
2. Prices
2.1 All prices and availability information appearing on the Website are provided to us by the Providers and other third parties.
2.2 We have no responsibility for the accuracy or completeness of the prices or availability information appearing on the Website.
2.3 As a general rule, prices are inclusive of taxes and charges but this depends on the terms and conditions of the relevant Provider. We encourage you to carefully read such terms and conditions before confirming your booking.
3. Payment
3.1 Each booking will be processed by the relevant Provider or a third party. We are not liable for any default by that Provider or third party.
3.1 All bookings must be paid in the manner specified in the relevant Provider’s terms and conditions.
4. Changes and cancellations
4.1 If you need to change or cancel your booking, you must liaise directly with the Provider.
4.2 Your ability to change or cancel any booking is subject to the terms and conditions of the relevant Provider.
4.3 Any change to or cancellation of your booking may incur charges or cancellation fees, depending on the relevant Provider’s terms and conditions.
5. Accommodation information
5.1 To assist you with the selection of accommodation, we use the rating system provided by Qualmark NZ or the Provider itself (self rated) enabling you to compare each property. Ratings are provided solely for the guidance of our customers and have no equivalent in any other rating system.
5.3 If you have any queries in relation to accommodation being advertised on the Website, you should contact the relevant Provider directly.
5.4 We are not responsible for responses provided by Providers.
6. No liability
6.1 You agree that the relevant Provider has the sole responsibility for providing the accommodation being booked by you and that we are not liable for any default by that Provider.
6.2 We will not be liable for any direct or indirect loss or damage suffered by you from booking or purchasing accommodation through the Website from a Provider or other third parties.
7. Changes to Terms and Conditions
7.1 We may from time to time change or modify these Terms and Conditions and will notify you of this by updating the “last updated” notice beside the link to these Terms and Conditions. By continuing to access and use the Website, you agree to be bound by the amended Terms and Conditions.
8. Severability
8.1 If any part of these Terms and Conditions is deemed invalid or unenforceable, the remaining provisions shall remain in full effect.
9. Governing law
9.1 These Terms and Conditions will be governed by New Zealand law and you submit to the exclusive jurisdiction of the courts of New Zealand.
